Probate

The passing or incapacitation of a loved one is a difficult time for any family. You need a compassionate attorney who can help the family save money and time through the sometimes confusing probate process. Let our office help simplify the probate, guardianship or conservator process for your family.

“I was more than pleased to meet Mr. Hairston. He was the attorney to meet my family’s needs. He made the probate experience smoother than expected. Although the circumstances were melancholy, his presentation and followthrough was and has been perfection in motion.”

Conservatorships

If you are caring for a loved one who is no longer able to manage their own affairs, it may be time to consider a conservatorship. In a conservatorship action, the Court grants a “conservator” the legal authority to make decisions concerning the person and property of the person who needs support.

Estate Claims

When a person passes away, the probate process helps to ensure an orderly process for making sure everyone gets paid—including creditors. If your business is owed money by someone’s estate, we can help.

Guardianships

Sometimes, a person under the age of 18 is left property. In these circumstances, the Court will need a trusted adult to serve as guardian over that young person’s property until they are 18. Other times, both parents are not in the picture and a guardian is needed.

Name Change

When your current name is no longer reflective of the person you are, you may need to shed the current name to get your new legal name established. Our office can guide you through this simple process.

Personal Representatives

Have you been appointed to serve as the Executor of an estate in a Will? Are you needing to open up an estate and be appointed the Administrator? Let’s sit down and chat so that you are clear on your responsibilities.

Probate of Intestate Estates

When a person dies without a valid Last Will & Testament, the laws of the State of Tennessee provide a process for collecting the assets of the decedent, paying creditors and determining who the heirs of the estate are. We look forward to serving your family during this time.

Probate of Testate Estates

If your loved one has left a Last Will & Testament, the first thing to do is determine whether it was validly executed. Then, we will help you review and understand just what the Will calls for so that you can execute the decedent’s wishes.

Probate in Common or Solemn Form

Most probate cases will proceed in “common form” which simply means that the person probating the Will does not expect a Will contest so they don’t have to follow the more stringent requirements of “solemn form” probate. We look forward to helping you follow the path your case need.
